Abstract
Standard-essential patent licensing is one of the forms of state aid. This paper studies the anti-monopoly principle of SEP implementation. SEP licensing has market failure problems such as license fee stacking, hijacking and anti-hijacking. In SEP antitrust cases, the interpretation of defining relevant markets is insufficient. Referring to the SEP case law in Europe and the United States in recent years, it is necessary to explain and expand the definition of relevant markets and substitutability analysis.
